(20 III. Suits in pendency
Obtaining information of the names and residences
in life of all parties to all the suits at present in pendency in
the Equity Courts is no more than what is already in the power
of the Commission of Enquiry in relation to the Common Law Court.
Inextricably involved with the consideration of the state state & practice of the Equity
Courts is that of the Common Law Courts. Accordingly propositions
applying to that of the Equity Court have been are included having
been received by them from Sir James Scarlett and are included
in this printed Report. That to to questions
tending to elicit the information answer would be refused, is more
assuredly than they would be constrained in assuming. Supposing them
not to ha the power of compulsion what wanting, no peremptory
objection can any such deficiency appear to the elicitation of
whatsoever can be obtained without compulsion
Suppose then suits, in any number all the parties to
which on both sides every one of them have joined in petitioning for
such arrangement will not such universal consent b suffice
for rendering it the moral duty of the constituted authorities to ensure
in giving effect to it? Can any reasonable objection be made
to such an arrangement with more reason than in this case
than in the common case of arbitration?
