1 Foreclosure. the event or state of things constitutive of the efficient cause of obligation to transfer the subject
matter from the mortgager or say consignator or pledger to the mortgagee having
taken place

Note that in the nature of the case a subject matter of
value or say a valuable thing in any one form is no less capable
of being made the subject matter of the transaction of this suit
in any other form — thing immoveable — thing moveable and
right to a sum of money or to a service in any one of a
variety of shapes

This being understood so may it be understood that
wills for example in the nature of the case the whole law of respecting
notes of hand is not less applicable not applicable with less advantage
to a corporeal subject matter moveable or immoveable
or to an incorporeal subject matter of any one of many other
sorts besides that denominated a sum of money than to the
immoveable subject matter which is the only one to which by under
law of England as it is that modification applies for the designation
of which the word mortgagee is applied.

In the nature of the case a landed estate to any amount
might in any or might as easily make the round of a gaming
table as a rouleau does, or a Bill of Exchange may do and under the law of Holland the
sort of facility it is said has place.
