Injunction suits for
mere delay, disposable
in a few minutes
Art. 17 In the case of an injunction put up
on a Common Law Suit for the mere purpose of
delay, the assertion on which the Bill is grounded
is by the supposition a fiction. In a few moments
a few words from the Plaintiff's Solicitor would
suffice for rendering this circumstance incontestable.
Here then is another class of suits for the evaporation
of each of which a few minutes would suffice.
The faith of the law, will it be said was pledged for
the giving to the mala fide suitor this advantage
The faith of the law cannot be more decidedly
pledged for the doing wrong, than before this it
was pledged for the doing right: in the one way
or the other, faith cannot but be broken. If faith
must be broken, better it were for a right purpose
and effect than for a wrong one — better in a right
cause than in a wrong one. And of the wrong doer
the suffering cannot be so great as that of the
party wronged would be.

So the greater number
of appeals
Art. 18. Appeals and causes set down and
waiting for hearing — 1. Appeals. for delay and nothing else. Many of these like injunctions
been brought into existence — for rendering it manifest
which of the several appeals are in this case,
the short account, such as may without difficulty
be elicited from the Solicitor on either side, would
suffice. The remainder may be left to take their
present course. Now would the time labour and
expence produced by employed in this day's attendance be thrown
away. For, by the elimination of these, the disposal
of the others in the ordinary way would be accelerated.
