In regard to Commissioners
appropriate aptitude the
that quantum necessary for
Justices of the peace is
sufficient

Art. 212. That in regard to appropriate aptitude on the
part of these same Commissioners of dispatch, [considering that]
all need of law-learning is as above put aside. by even of that
quantum which being necessary to the due discharge. exercise of the
functions of a Justice of the Peace is assumed to be in the possession
of every man who acts in that same capacity.

Not that of appropriate aptitude is this law any evidence
that could be had would be otherwise than beneficial: but
that by from any alledged difficulty of securing the existence of
such aptitude no object reasonable objection to the plan
could be opposed declared.

Messengers & Prehensors
to be attached to Commissioners
of dispatch

Art. 23 That attached to and under the orders of
each Commissioner of dispatch be a competent number of
functionaries serving in the capacity of some of mere Messengers
others of Prehensors with power to exercise such their
authority as such on the body as on subject matter of
property immovable as well as moveable; with power
of sale applicable to both. So far as regards things
moveable this power of sale is no more than what is exercised
by every Constable at the command of every Justice
of the Peace: so likewise by almost any person whatsoever at the command
of any Landlord whatsoever. In this particular
the here proposed experimental Court will have the of the
existing Equity Courts, which, having given up as it were
sub solentio, have not any more than the Ecclesiastic Courts
found any time, in which they could have put in with the
Common Law Superior Courts and the Justice of the Peace
General Courts, for a share in the services of the Sheriff
of the County — the common drudge herein above noticed under that
character.

Expence of maintenance of
Commissioners for life

Art. 24 A change to be throughout guarded against is
the loading the public with the expence of maintenance for life of a
functionary whose services have been rendered for no more than a short
time.

Sole exception County the Sheriff of which forms an exception
Middlesex: but by this exception the eye is led to the rule. Art. 22
