5. Supply of Judge powers
C For a constant supply of Judge power,
this premium mobile sufficient for the exclusion of the evils, composed of
correspondent and opposite to the ends of justice: that is to say
non-decision for want of commencement, non-decision
subsequent to commencement, and needless delay, expence
and vexation during continuance, provision under the existing system,
summary mode of the existing system, provision precarious, and on the whole inadequate. Of persons
empowered to act in this judicial situation, the number
indeed great, and here and there superabundant;
and these, every one of them, empowered to act every
day in the year, and on any hour in the four and twenty,
if so it pleased him: but no one of them laid under any
obligation of so doing: whence, the adequacy of the supply
is left to depend, every where and at all times, — either on chance
or, what is worse, on choice, determined by particular and
sinister interest: on no one any obligation to give
commencement to any suit: a suit commenced on
no one any obligation to give termination or continuance
to it: not to speak of the door thus left open to
undue favour and disfavour, of which further on.
