5 First, as to the Procedure Code. In the cosmogony of the existing
system of Procedure, the two conflicting principles — corresponding Codes, or say the originally
existing evil and the subsequently created good — in a word the portion of a matter stand distinguished. 1. That stiled
so styled regular in that stiled and the summary — have, in the Petitions
for Justice, been continually held up to view.

Under the existing System, Occupied in the
administration of justice according in to the summary mode
of procedure, summary mode will be found seen to be four different sets of Judicatoriesries — |
1. Judicatories, constituted by composed of the functionaries stiled
Justices of the Peace, while acting, singly, or, if in bodies,
otherwise than in the sort of Judicatory called stiled The general sessions
court: but in those cases only, in which, by the exercise
of that authority, continuance and termination, as well,
as commencement are given to the suit: putting aside
as not belonging to the present purpose, those cases in which, in pursuance of Device the

2. The Judicatories stiled Small Debt courts: otherwise

3. The Military Judicatories, stiled Courts Martial.

4. The Judicatories, composed of Members of the House
of Commons, in so far as employed in the elicitation
of evidence, to whichever of the pur purposes destined
the legislature — | in the exercise of which-soever of its two functions —
to be employed: namely, in the forming of a ground
the legislative and the judicial, destined to be imployed.
