So much for institutions. Now for conduct and character
of rulers, Legislators and Judges in the two countries

said experience of several ages that we have arrived at the
perception of the extreme imperfection of the civil branch of the
laws in relation to on the subject of Judicial procedure, the dangerous abuses
which are the result of their imperfections, and the infinite difficulties
which oppose themselves to improvement in this branch of
this legislation. Chicane, Lawyercraft the influence of pettyfoggers rabulistes, the
mutual antipathy ill will of parties, the partiality of Judges, the uncertainty
in the wording of the laws, the obscurity and
darkness in which the matters of fact are so apt is so liable to be invoked
all these are so many obstacles against the resisting force of which
the improving hand has to contend. In vain have legislators endeavoured,
by wise and beneficial laws, to chase down the temerity
of pettyfoggers (rabulistes), to rouse into action the lethargic sleep
of Judges so (le sommul lethargique) (a) of Judges: in cases in
which the legislator had flattered himself with the hope conception of his (a
having succeeded applied an effectual contract to the operation
of the Code of law Law Courts but often has the inaptitude
moral as well as intellectual and action of the Judges
and Advocates disappointed t the foresig baffled the foresight
and disappointed the expectation of legislators.
