1 Gainers by the denial

Well then these two classes of persons by whom in relation
this argument is employed what are they.

Answer. One of them is composed of those who either are, or regard
themselves as gainers by the denial.

Those who are gainers by it, are lawyers the whole
sects or say fraternity or brotherhood of lawyers, official and professional
included. Of the Exaction of fees is the instrument
by the operation of which this benefit is obtained. and truly Admirable Exquisite is the degree
of perfection with in which this instrument is adapted to its intended
use. Without producing benefit in some one or other of two shapes,
benefit to those by whom to this one use their fees are received, as
likewise to all those who in this respect possess with them a community
of interest, no one application of it can in any an individual
instance be ever made. The individual of whom the fee is demanded
is he at the same time able and willing to pay for it?
If so, the benefit is received or takes the shape of pecuniary emolument. Is he
either unable or unwilling? the benefit in this case takes is received in the
shape of ease. Here however a distinction has place between
the official, and the professional lawyer. Over and above that portion
of emolument which is composed of fees, care has been taken to secure
to the official lawyer in the highest to be another portion in the shape of
salary: and so vast in England so vast is this portion, that for the
sake of the ease of some there are who might not be altogether unwilling
to give up the fees could they by that means be altogether
exempted from the labour of attendance: the salary being more than
ten times as great as that attached to judicial offices of the same
grade in other countries. France for example: and no treat
having ever been made, it is not how much more than ten
times as much as is necessary, can not be said. Not so in
the case of professional lawyers: their emolument being of necessity
composed of the whole of it of fees.
