[In a word] Features by means of which the good effects
of the institution are produced, two: that is to say

1 Bringing together the adverse parties together in the presence
of an arbiter or set of arbiters who have so situated as
to have inducements to bring about a termination of the
contest without liticontestation, and no inducements to
promote the commencement of liti that mutually vexatious
process.

2 Delivering an opinion
as to probable result
of the proposed suit

2. [Delivering an opinion] In respect of the probable terminated
result of the proposed suit, delivering an opinion not exposed
to the influences of any sinister interest tending to the production
of a mode of termination adverse to the justice of
the case: this opinion having for its grounds the state of the
facts of the case indicated by a mass of evidence more instructive than
that would be likely to be elicited in the regular mode of
procedure pursued in the ordinary Courts: this opinion having
as compared with the opinion in use to be obtained from law professional law advisers
having
the advantage of being grounded in l a view of the facts
statements made and evidence produced on both sides instead
of being grounded on those opin having for its grounds as is the case with
those professional opinions the for statement of facts without
unsupported by evidence, and likely to be misrepresented
by the narrators self delusion particularly to his own causes
— by the bias which desires are apt to give to the opinion themselves
really entertained as well to the opinions professed to be
entertained: and the advice thus obtained from opinions
in so superior a degree more trustworthy than the opinions
customarily obtained by purchase, obtained gratis
