3. Now for the importance ascribed by the Danish legislator
to the personal appearance of the parties before the Judge at the very
outset of the suit, and the importance which actually belongs to
this arrangement actually belongs

More express are the terms in which this arrangement
is spoken of as one which constitutes the leading feature of
the system: over and over again in this same character is it
brought to view. First, in page 42: then in p. 54, then again
in page 59.

Now as to the importance really belonging to it. The
prodigious quantity of good effects produced by the institution have been seen and (the observation that
supposing this out of the case sitting under this, no other arrangement can be assigned, in which
any tendency to the production of any such good effects is observable
and that the imperfection which will be seen found to be observable
in it

Note here that except by the agreement between the parties
the consent of both is has been given, to the efficacy of an order the imperative decree for this purpose,
no execution to the whatsoever be the desires aspiration of this no
correspondent imperative decree can be offered no in no case any execution and
effect be given to the operation.
