§2. Elucidation.

By this feature the single-seated summarily proceeding Judicatories
may be seen placed, in the scale of appropriate
aptitude, on a level, upon the whole, considerably elevated above
that of the many-seated summarily proceeding
Judicatories: yet thus upon the whole , though not without being in some degree depressed, by a comparative
deficiency in respect of certain securities
for appropriate aptitude, for the number of which the
demand now presents itself as indispensable.

Of those securities, samples already brought to view
may be seen in that part of the prayer of the Justice
Petition which applies itself to the Judiciary Establishment:
namely in paragraphs 5, 12, 13 and others of
its 27 first paragraphs.

But of the whole of them, those included,
a list, ample to a degree which It is hoped will not
be thought altogether unworthy of observation, has
for several years been contained in the above-mentioned
Constitutional Code: and, forasmuch as, compared
with the importance of the subject, and of the
object aimed at, the space occupied bt the mere list
seems not much in danger of being regarded as excessive,
and as, in the instance of a considerable proportion of the
whole number, a tolerably clear, correct, and comprehensive
conception may perhaps be formed from the several
descriptions, compressed and concise as they are, or even
from the bare denominations, here follows the relevant
part of the matter of the section in question, as it
stands at present in that same proposed Code.
