☞ This is to come after the security and before the Parallel.

One word as to the Petty Sessions, Judicatory.
What belongs to the mode of procedure and the mere number of the seats has been already brought to view. In the character of an efficient cause of irresponsibility and thence of inaptitude on the part of the functionary, the multitudinousness on the part of those same seats was on that occasion brought to view relative to functionaries in general, to Judicial functionaries in particular. 1. First, as to the mode of Procedure. In the case of
the many-seated Judicatory, it is the same as in the single-seated.
Superiority over the regular technical procedure,
in the scale of aptitude, consequently the same.
II. Next, as to the Judicial Establishment. Species of Judge
also the same. In the inaptitude degree of amplitude in the of the logical fields
of authority, and in the number of seats, and the circumstances what belonging
to that number, lie the only differences.

1. As to the amplitude of the field. Abundantly more
ample than the field of the single-seated Judicatory
is that of the many-seated Judicatory: for, including as
is does the whole of the logical field of the single-seated Judicatory, it
has moreover a logical field to itself. But this difference
belongs not to the present subject. What
belongs to the present subject is the difference in respect
of the number of the seats, and it will be seen in what
a degree in the scale of appropriate aptitude the place
of the many-seated Judicatory is by this circumstance
sunk below that of the single-seated Judicatory.

Of the inaptitude of the many-seated species
of Judicatory in the generality of cases, the efficient causes
have been brought to view elsewhere.

But, in this particular case, two additional
and distinguishable efficient causes of inaptitude manifest
themselves. These are — offer themselves to view.
I. Cause the first fluctuation: Fluctuation of the number
of these Judges actually in attendance during the continuance
of the suit. At the commencement, two is the
least number that can be present, and may be also the only
number. But, in the cause of the suit, others in any number
may drop in, and the two first, one or both of them, go out:
and the number may they
change from one day to day, or
from hour to hour, or any
or every day.
2. Cause of the second, optionality:

between attendance and
non-attendance, on the
part of every each one of them.
