2. Evil the 2d. Optionality as to attendance.
optionality on the part of every one of these Judges, — optionality,
as between the whole of the time and none, and as
between every each part of the time and every other:
thence, power of giving his contribution to this decision,
on delusively partial evidence, or without regard to evidence:
and this without censure at the hands so much as checks of public
opinion: not to speak of legal punishment: [+]

Judges springs the above
mentioned danger of
injustice intended or not

For gratification of groundless hatred
or of predatory rapacity, in the breast of a real man, a breast occupying a level high in the scale of opulence an unjust
decision is determined (suppose), to be pronounced
at the charge of a Man. one whose place is on a degree sufficiently lower in that same scale. Number of these
Judges empowered having right to attend (suppose) five — all of them
(suppose) conscious of the injustice. Between the dishonest suitor
and two of these five Judges, the connection formed by community
of sinister interest so close, that these two, for their
share of the benefit of the unjust decision, are content to
stand exposed to the censure of public opinion. As to The three
others, they would not (suppose) any one of them, have been this handy:
had they been in attendance, the decision would accordingly have
been accordingly in favour of the intended action; such, that the victim marked for sacrifice and

object, their absence

exposing themselves to censure at the hands of that or any
other authority, they stay away
True it is that, in this way, the evil effect immediately
produced is not, in the instance of any one of these
corruptionists equal to the whole of the evil produced by a that which in case of and
might have been produced by him by means of a note given on the wrong side: it is, however, equal to one half
of that same evil effect; and where the ultimately produced evil is
in both cases the same, any difference in respect of the intermediate bad effect amounts to nothing.
