II. Small Debt Courts.
III. Devices, the employment of which,
presents itself as being in the English Justice of Peace Summary procedure System pretty effectually discarded, does not
though in its mischievous efficiency reduced, does
not present itself as having been entirely discarded,
either in the Scottish seem to be so in the procedure, either
of the Scottish, or of the English Small Debt Courts.
1. VI. Delay, in groundless and boundless length,
necessitated.
2. (VII.) Precipitation necessitated.
3. (VIII.) Blind fixations: that is to say, of times
for judicial operations.
4. (IX.) Mechanical, substituted so mental, judicature.
N. B. Of the evils expressed by the words delay
and Pprecipitation, and Mmechanical judicature,
the chief source, in the case of these Judicatories,
seems to be a in the application made of the
blind fixation principle, instead of the intercourse-securing
principle, as applied in Art. 28 to 33 of the Prayer
part of these Petitions.
So much for Procedure; now for the
Judiciary.
I. Number of Judges in the Judicatory.
1. In the here-proposed system, one and no more.
2. So, in the Justice of Peace system, in the cases here in question.
3. So, in the Scottish Small Debt Courts system; and, So
far, so good.
4. On the English Small Debt Courts system,
a multitude: in the different territories local fields, the number
in an indefinite degree various; and so far
so bad, as above.
