VIII. Remuneration.

1. In the here-proposed system, shape that of a fixt
salary: the emolument unsusceptible of any the smallest
addition without effectual exposure to legal
punishment: thence not in any degree corruptive.

2. In the Justice of Peace system, salary, none:—
emolument, not great, but to the whole extent of it
corruptive: namely in the shape of fees, the aggregate
amount of which is not unsusceptible of increase
by similar practice: which increase is a proportionateable
source of corruption to the functionary: in a direct way,
in the shape of income, if and in so far as he puts any of the money into his
own pocket; in the way of patronage, if and in so far as
he turns it over to his Clerk: the corruption differing in
nothing but degree of effective force, from that which has
place in the case of his superiors — the Westminster
Hall Judges — by which the whole of the justice selling-and-denying
system with all its is produced.

3. In the Scotch Small Debt Court system, howsoever
the case may be in regard to fixt salary, corruption;
in an a prodigious degree, has been shewn to be the effect of
the mass of remuneration allowed in the fee-gathering
in No V of the Jurist. This in the present state
of the system; and in this particular the Bill
in question makes no undertakes not to make any difference.

4. In the English Small Debt Court system, in
respect of corruptive effect, the matter stands upon
much the same footing as in the case of the Justice-of-Peace
system, as above: though, in degree, the corruptive
force is, generally speaking, it may be supposed,
inferior.
