Supplement
§.2. Elucidation
II. Small Debt Courts
11
Follow remarks as to
1. Intercourse-securing principle
See Prayer 28 to 24
2. Responsibility Securing principle.
See Prayer 35 to 38
Note (a)
(a) Note here: better late than never. Under the here proposed system use is made application
is made of two principles constituting so many leading features
[under the name of] the intercourse securing and the responsibility
securing principles. Of the application made Of the intercourse securing principle the aptitu
some intimation may be seen conveyed in the paragraphs or say just
referred to: of the application made of the responsibility securing,
in the articles from 35 to 38
12
1. Intercourse securing principle
Use are none made of it in
1 English existing System
2 Scotch do
Of the intercourse securing principle no application
has place it is believed in any part of the English regular or
summary of after the English system or the Scottish system
13
3. In French yes: viz.
Election de Domicile.
But the provision made
is inadequate.
In Bonaparte's Codes it has place in the case of
the election de domicile: but instead of instead of being employed constantly
it is employed only incidentally in the period at which it remains is instead of being the very
commencement of the suit, or this or that period of time during
the continuance of the suit: neither does it as under the here
proposed system apply to all of the dramatis personae other than those
in whose instance there is in need of it viz functionaries belonging
to the Court, but only to parties to the suit.
14
Regret that before
printing Art. 28.
of the Prayer, this principle
had not by name presented
itself.
As to these two principles it is matter of regret that at
the time of the application made of them in the above as above, the
denominations here employed in giving expression to them, had not
as yet presented themselves
15
2 Responsibility- securing,
Its object, minimizing
incidental evil, to
parties and
non-parties
The responsibility securing principle had for its object
the minimization of evil in every shape, considered or liable
to be suffered, or done by any of the actors in the judicial
drama: more particularly those who not belonging to the judicial
Establishment may be distinguished by the term extraneous; as
the demand of need of permanent description presents itself, so by design one after
another do appellations more or less suitable to the purpose.
