§. III. Third course of parallel-affording course of procedure
that of Courts Martial and Judicial Establishment

First Third as to course of procedure

1
Exceptions excepted Courts
Martial in accordance with
proposed system.

1. Exceptions excepted, Court Martial
system practice is under this head in perfect accordance with the with the
here proposed system.

2
Exceptions 1 no intercourse

3
From the omission no

against Courts Martial.

From Not that by these omissions, no inference any argument
is suggested afforded either against the here proposed system, for
the employment given which is given to them, — or against
the Courts Martial practice for its omitting to employ them.

4
Under proposed system
these arrangements employed
because necessary in every
sort but these excepted
Judicatories

Under the here proposed system these are employed,
and why? Because, in the case of every sort of judicatory
but those excepted Judicatories, they are
indispensably necessary to the good administration fulfilment of the ends
of justice.

5
In excepted judicatories
not employed because not
necessary for ends of Justice

Under In the excepted Judicatories in question
they are not employed. Nor need they be employed.
Why? because by these in these instances the employment of them is not necessary
to the fulfilment of the ends of justice. Without any
special arrangements made on purpose, the relative situation
of the members Judges of the judicatory on the one hand; and
the Judgeables (so to speak) on the other hand, suffices of
itself for both these purposes.
