Superiority of Justice
of Peace Court procedure
over Westminster Hall
procedure Cause
No device employed for attainment
of ends of Judicature

Of the two the above abovementioned sorts of summarily proceeding
Justice of Peace Courts which regards for the practice hath, as above, ba been
stated as affording a model not very far from perfection,
and, at any rate affording a striking contrast contrast as compared
with the practice of the Superior or say Westminster
Hall courts. Why? so near to perfection? Answer. Because
unsoiled by those the devices which were invented for the
attainment of these actual ends of judicature which are the with such
lamentable exactness are
opposition of the ends of justice.

the same Court. Cause
No intercourse and responsibility
securing
arrangements

Why in any degre degree short of the pinnacle of perfection? Answer.
Because not provided with and with any thing better than some scanty fragments of those same
intercourse and responsibility securing arrangements; together
with some others which the description of which the limits necessarily presented to the
present tract would not admitt of.

Next comes small debt
court procedure because
it is un comparatively
speaking little defiled
by the abovementioned
devices.

Next to the procedure of the summarily proceeding Justice of
Peace Courts came, as above stated, the course that of the Scotch all comprehensive
Small Debt Sheriff's Courts, and that of the here and there scattered
English Small Debt Courts stiled Courts of Request and Courts
of Conscience. Why? Because though in neither of these instances
does the practice procedure stand altogether undefeted undefiled by the
arrangements produced by those same so continually and unavoidably
mentioned Devices, yet in both instances it stands
for the comparatively speaking but little defiled defiled by them.

So much for the procedure part of the practice.
