XII Decision on grounds avowedly foreign to the merits. Yes
with little not much less frequence needless frequency and apparent delight
in France than in England; but not in language [so] conclusively
probative of the alread non existence of any such sense as
the sense of shame. When in among English lawyers a phrase of
which the principal word is merits is employed, in the French
is employed a phrase in which the principal word is fraud
to from which stands contradistinguished and to it applied the word

XII. Juries subdued and subjugated. the Into French
legislation the introduction of the institution being so recent, no
place has there been for the application of this device. In cases
in which it more determined disserviceable than serviceable to justice the institution
is to no inconsiderable extent employed, but where as in England
it is of real use the use of it is of so great and indispensable, then rather
than not have it, better give to it in such great extent in cases
in which so far as regards these cases in particular, it is disserviceable
to justice

a degree but not in a degree now so great and misadvic disastrous to justice as in English practice.
Should these short heads have the effect of inducing the
author of Espirit, Origine et Progrès des Instructions Judicinere
des principaux Pays de l'Europe to pursue them, important would be the service rendered to justice
throughout the civilized world.
