Questions

Curious and instructive in the
highest degree would be the history and ætiology
of the Justice of Peace summary procedure.
A few hints, and these in a state of the utmost condensation,
are all, for which, on the present occasion,
either space or time can be found.

1 Whence came the
institution?

1. Whence came the it — this same institution of judicature,
performed by Justices of the Peace, all the year round, each
at his own home?

Procedure why
summary?

2. At the commencement of the institution
whence came it that they betook themselves to a
course of procedure, so properly stiled summary
in comparison of with reference to the regular, and forming so striking
a contrast with it?

Without the assurance
of finding apt persons ready to
take the office no originator
would have taken the matter
in hand

Conjunctly, if at all, must these two
questions receive answer. Without the assurance
of seeing persons suited to his purpose, ready to take upon
them the judicial office, scarcely would the originator, of an
institution of this sort in Parliament have taken
the matter in hand: and on this occasion, to himself for one to himself in the character
of a Justice of Peace for his county — to himself for
one
he would, he, of course, look in the first instance.

Condition required by and
for the functionaries

On the same occasion, conditions naturally required by and for these functionaries, would be these —

1 No exercise of the
function obligatory if
disagreable

1. That, [+] [+] as to good liking, at no occasion moment of time should they, any
one of them, be obliged under obligation to give exercise to the function;
unless, at that very minute moment, it were agreeable to
him so to do. For the repugnance of such a condition Commonality will controul for the accommodation
of the individual; but for its effect with reference
to the ends of justice, see above.

2 No absence from
home obligatory if not
agreable

2. That, as to time place at no time should it be necessary
for him to act elsewhere than at his own home or in
some other place, equally agreeable to him, and consequently
not far distant.
