§.2. Elucidation
Ætiology & History
§. Ætiology
Curious and instructive in the highest degree would
be the history and ætiology of the Justice of Peace summary procedure.
A few heads, and these in a state of the utmost consideration are all for which,
on the present occasion, either time or space and or space can be found.
1. Whence came the institution of judicature by Justice of the Peace acting,
all the year round at their own homes each at his own home
2 cause the course of procedure on which at the
commencement of the institution when came it that they betook
themselves to a course of procedure now stiled so properly stiled summary and
in consequence of the regular, and forming so striking a contrast
with it?
This had conjunctly if at all

the judiciary business be taken in hand, of course the following:

1. That, on no occasion, should they any one of them be obliged
to give exercise to the function unless at that very moment
it were agreable to him so to do. For the repugnance of such a
condition to the ends of justice, see above.
2. That, at no time should it be necessary for him to give to
any one act elsewhere than at his own
home or in some other place equally agreable to him, and consequently
not far distant
3. That, on no occasion should it be matter of duty to
him to proceed, in any other course or manner than he would, if sitting
