§.2. Elucidation.
Ætiology and History

Instructive and important with a view to practice in the highest degree is one
observation with which this discussion exposition may conclude. Much For
Abundantly More impressive and probative by deeds than if by word
is the certificate given by Parliament — given by every Parliament,
from the first by which an example exemplification of this summary
system course was exhibited, down to the present — of the utter
inaptitude of the regular course in all the several so numerous
and diversified ramifications of which the tyger-stuffed
jungle is composed.

That by from the purpose to which subsequently the information
obtained happens subsequently to be applied the course best
adapted to the ascertainment of the truth as to a matter of fact
is susceptible of receiving diversification as a proposition
to which, while in this its most extreme degree of
generality something in the shape of agreement might not
altogether impossibly be opposed: that by from the powers given to the
person occupied in the investigation the a demand for such diversification
is not incapable of being produced, might also
perhaps with some plausibility, in so long as the subject is
kept hanging in the region of vague generalities at a certain
degree of elevation, be maintained: the more important the
practical result of the investigation, the stronger and
eventually the more afflictive (it may be said) the powers, which it may be
the institution of which may be rendered
consistent with the ends of justice. But that the aptitude
of the course can be diversified by and rendered dependant
on, the denomination given to the aggregate of the functionaries
so occupied in the several cases, — as for example Common
Law Courts, Equity Courts, Bankruptcy Law Commissioners
Insolvency Courts, Courts of Request Court
Military Courts, Admiralty Courts and so on without end
this security is in proportion too flagrantly absurd to admitt of so much as the shadow of an argument.
