Supplement
§.2. Elucidations
History and Ætiology

or 5
Not injurious the
imputation.

Still worse the incontestable
extortionary
swindling

A man of character in the profession — they Keep back the proceedings this being their interest of sacrifice his
client — they betray his trust all for the sake of filthy
lucre! alas how ungenerous, how calamitous the imputation!
Not do this? not do this constantly and in
on every occasion and constantly? what should hinder
him? Charge for Exacting payment for operation not performed — exacting payment for delivering of instruments not
delivered for framing of instruments not framed in the Common Law Court is not
this the consistent practice on the part of all attornies
they being either sometimes compelled or allowed to do so either
by the Judges either in the immediate way or by the intervention
of their subordinates in the Equity Courts on the part
of all Solicitors they being compelled so to do by the
subordinate Judges called Masters.

"A man of character in the profession do all this"? asks
somebody Not do this? what any body: then comes rung then
come the changes upon the words
a cry of Materality, slander, calumny — and so forth.
Not do this? you and also? why? why not? what should
hinder him? Not do all this? you and much still worse
than all these

Think of the obtainment of money on false pretences — so
so in statute the language of the statute the swindling in the common language
of common parlance the swindling aggravated by
extortion — by extortion practice selecting for its victim
the already injured and afflicted! a Attorneys, Judges and
of so many different grades ranks and denominations, with their inferior Subordinate
subordinate officers of so many denominations — the attorney.
not only allowed but compelled so to do by the
Judges — all exacting payment for operations not performed,
exacting payment for the delivery of instruments not delivered
exacting payment for the framing drawing up of instruments
never framed so much as drawn up. More than once has come the need of bringing
these things into view, never for a moment ought should
they be out of mind. Regular all this? beyond dispute O yes: regular beyond all dispute.
Regular in good truth, beyond dispute But necessary to justice? to the discovery
of truth? O Yes: exactly as necessary to truth and justice as arsenic to life
and health. [+]

[+] On the other hand,
one glance now back
on a scene on which
an honest eye may
find for a moment,
a so much needed
repose. Under the
here proposed system,
in every suit whatsoever information,
from any source, in
any shape, it has
happened to the individual
case to have
furnished, is elicited
and brought to view
at the earliest time
possible, consistently
with the avoidance
of preponderant evil
in the shape of delay
vexation and expence
