Sole case where decision
by affidavit is summary
that when it is conclusive
Counter affidavit admissible
dispatch is the surface
only delay as well as
expense immediately
underneath.
As for evidence elicited in the shape in
which property to the amount of so many
millions — property? yes, and life itself is disposed
of by it — evidence in the shape of affidavit work,
it is, in each instance, made or not made, conclusive
of the fate of the question. If conclusive the
case falls under the just-mentioned description, and
summary the course of procedure in so far as it
gives employment to this same evidence really is.
But if it be not made conclusive, summariness
is upon the surface; dilatoriness immediately
underneath; substracted indeed and saved in counter-
interrogation; but, added, is counter-evidence,
that is to say counterjustestification: this, with
an interval of indefinite length, interposed between
every instrument of testification or deposition
(as the name in use is) and every other.
