§ 2. Elucidation.
History and Aetiology.

Not injurious the
imputation
"A man of character in the profession do all
this?" asks somebody anybody: rung then are the
changes upon the words illiberality, slander, contumacy
— and so forth. Not do this? Why not? what
should hinder him? Not do all this? Yea and still
worse than all this.
30
Still worse the
incontestable extotrion
swindling
Think of the "obtainment of money on false
pretences" — so in Statute language swindling, in
common language the swindling aggravated by
extortion — by extortion selecting for its victims
the already injured and afflicted! Attorneys-Judges
viz. of so many different grades and denominations, —
with their subordinate officers of so many denominations! —
the attorneys not only allowed
but compelled so to do by the Judges — all exacting
payment for operations not performed —
for the delivery of instruments not delivered —
for the drawing up of instruments never so
much as drawn up. More than once has
come the need of bringing these things into view:
never for a moment should they be out of mind.
Regular all this? O yes: regular beyond all dispute.
Necessary to justice? to the discovery of justice truth?
O yes: exactly as necessary to truth and justice
as arsenic to life and health. On the other hand,
one glance back on a scene on which an honest eye
may find for a moment, a so much needed repose.
Under the here-proposed system, in every suit
whatsoever information, from any source,
in any shape, it has happened to the individual
case to have furnished, is elicited and brought to
view at the earliest time possible, consistently
with the avoidance of preponderant evil in the
shape of vexation and expense.
