So where service
demanded is compensation
or subjection to punishment.

Every man whose wish it is to So again, suppose
at the charge of any man suppose compensation or satisfaction in any other shape productive of benefit
in any shape to the a
party alledged to have
been sufferer by the

in any shape demanded on the score of a wrong in any shape
alledged to have been committed, and as a condition
of his being admitted to save himself from the burthen of yielding
such compliance satisfaction as the burthen of enduring such punishment
payment of a fee demanded by or by authority of
such the Judge, every man whose wish it is, to obtain without
having right on his side any such pretended satisfaction to any
any amount whatsoever and for example to such an amount
amount as to swallow up the whole means of sustenance
of the his intended victim, or to obtain the gratification of seeing
him subjected to any punishment how heavy so ever though it be
the licence provided by law and for example the punishment
of death beholds in the Judge a man prepared to licence
the instrument of such injustice — an accomplice in the commission
of such injustice an instrument by the use of which such injustice
will accordingly be committed, if so it be, that while he
the mala fide plaintiff perseveres in his demand, the person
so denominated defendant is by inability to pay such
fee deprived of the capacity of contesting such demand — of
actually defending himself against it.

not inflicted on mere non-contestation
unless
proof given of the alleged
delinquency

The only difference that has place is — that in so
far as punishment is in question, it is not in every case that by
of mere non contestative punishment without positive
allegation in the shape of evidence affording conclusive proof
of the alledged delinquency, the punishment in question will be
inflicted.
