such thing. In the first case comes the evil of punishment;
which being by the supposition uncompensated
by any advantage is so much pure mischief
the work of tyranny and persecution: a mischief
the same in kind but much greater in degree
than if the same suffering instead of being administer'd
by the
hand of the magistrate
were administer'd by
the hand of any unlicensed malefactor. In the latter
case the mischief does not obtain is of a more remoter
remote and less perceptible but little less baneful
kind. The subject has been suborned to suffer commit a
falsehood: and it is the legislator who has suborned
him. But falsehood which is the great grand instrument
of iniquity and which can never unless
in a very particular cases by some very extraordinary accident be requisite
for the purpose of doing good is on that account
very generally and strongly reprobated by the moral
sanction; and the more so the more publickly
