14 Indirect Legislation
there any of these [of which he has the disposal]
which are of his creation, would might in point of proportion
be apt not to quadrate with those the
the measure which he would think proper to establish:
of two [rival] offences both of which he would be for punishing,
the religious sanction might appear happen to punish
most that which he would punish least, and
so can of option an option made by the offender determine the preference to on the
opposite side to that on which he would be disposed
to determine it. For though it were settled that
the dictates of the religious sanction in po its point of direction co-incides
with the dictates of utility or with those of the
law, still it may still happen that the degree of punishing
force with which it acts in each particular case
shall not be [looked upon as] determined by those
dictates, but by [each man's] particular imagination
of the person on whom it acts. (a)
Influence — Hen. 8
— risquing a war and
committing murder to
save adultery.
(a) Henry 8th King of England may serve for an example
He That prince as is well known had a taste for variety in his amours,
and at the same time a religious abhorrence for of the
sins of adultery unhallowd love and incontinence. Passion would
not suffer him to be guiltless: prudence again required
the preference of the more venial sin. The course he took
was first to marry a woman in the face according to the ordinances of the church
and then either to cut her head off or at the hazard of a war to
beg a div license from the head of the church Pope to put
her away. Three times by this management he procured
a fresh partner to his bed.
