same degree; and they must be at the same time
within the compass of the offender's power: in short they must
be such as a man is likely to have at one
and the same time as well on the one hand the power to
committ and on the other hand as the inclination to committ . First In the
first place then they must be offences of the same
motive. Accordingly there is no competition for instance, at least in ordinary cases [at least] between simple
corporal injuries and stealing: if a man has a
bears a grudge to another and on that forms a therefore finds
design of beating himself disposed to beat him it is not an opportunity of
stealing a purse of money for example that
would satisfy his anger. Whereas if a man
finds himself in want
of a sum of money,
and thinks of possessing
himself of
it by robbery, an
opportunity of possesing
himself of
it by theft would
answer the same
purpose.
In the next place they
must be offences of the same opportunity. An man who has having public money in his hands resolves
by officer of the revenue who has having a
quantity of the publick money in his hands, determines
to make himself master of a certain sum
though it be at the expence of a crime, may
easily have to choose, for instance between embezzlement
in breach of his trust and robbery: but a man who is in no such
office, can have no such choice. So again
