Thirdly, with regard to the restraining certain
mischief, that is mischief committed to no purpose
encreasing the [danger of detection.] facility of discovery In order
that detection may be compleat two things must
corres Now the purposes for which [detecting] discovery is
necessary and to be wished for are two: 1. the
putting a stop to the mischief of the offence in the
instance in which it is [detected] discover'd ; and 2. the punishment
of it for the in the view of preventing the
commisssion of the sa like offence on future occasions. In putting
a stop to the mischief of the offence the principal
point is generally the interruption of the enterprize:
though in particular cases where for example the mischief
is of a spreading nature as in incendiarism further as in incendiarism
and ind inundation may be a means condition
requisite to the takin further measures may be
requisite Now in [Detection] Discovery is not compleat unless
two points be ascertained: 1. that such or such
an offence has been [or was about to be[ committed: 2. that he who
committed it was such or such a person: [detection] discovery
accordingly in every case divides itself into two
branches:
