§ 6 Non-Seduction

It should be observed that whether government administers
the incentive itself, or suffers it to be administered
by others [is the same in effect and indeed in substance.] comes to the same thing. A gift
is not valid, unless [adopted and] sanctioned by the law.
I mention this, lest the examples which I shall give
under this head might seem appear some of them not
to belong to it.

It may also be observed that when it is alledged
the tendency of an emolument conferred or allow'd to be
conferred by government is ac alledged to be pernicious,
the doubt may turn or obscurity may be in turn upon
either of two points: 1. whether in the production the
quality tendency of a certain act be is pernicious: 2. whether in
the capacity of an incentive it be the tendency of the
emolument to give birth to it.
