Indirect Legislation

Satisfying

With regard to persons remaining under the
suspicion of crimes which can have not been proved
the difficulty will be to determine whether they
shall be compellable to aggregate themselves to enter into such an establishment
one of these working parties, or only receivable
upon their own spontaneous application. Strict and
inflexible justice seems to dictate reject the former course:
but upon the principles of expediency and humanity I question whether
it ought not receive admitt of a justification. The argument
against it is forcible: but more so in form, than
substance. Either a man is guilty or he is not: if
he is, punish him with the regular punishment.
if not, why punish him at all?" — Either he is
guilty or he is not: this in point of abstract
truth is undeniable. But in forming any
practical conclusion derived from supposed matters of fact the basis of our judgment
must be not the abstract truth of things [which
in matters that do not come under the immediate
cognizance of our own senses we can never know]
but the sentiment of belief disbelief or doubt
[which we have formed concerning them] which
have been produced in our minds by such view
as as have it has lain in our way to take of
the circumstances of the case. Now this sentiment
or persuasion admitts of an infinite variety of
degrees or modifications: for which in common
speech
