Satisfying
Whatever may be the expediency propriety of imposing
this obligation upon persons barely suspected of
crimes misdeeds such crimes of indigence, the exigency propriety of such an institution will appear
at least equal in the case of convicted criminals
malefactors whose terms of punishment are elapsed.
In the one case there is but a nothing but suspicion: [of such
a disposition in the other case there is certainty. fact
perfect proof. True it is that there is a chance
that the punishment may have operated
with effect in the way of reformation: still however
it is but a chance. If the description of
the case in which such obligation is to take place
be framed with proper care caution, one may say the
presumption whatever it may be which results from
that chance will be repelled by a much stronger:
For if a man refuses to betake himself to the
only honest livelyhood means mode of subsistence that presents itself, it
is plain his intention must be to betake himself
to a dishonest one.
