Indirect Legislation

§ 3 Power

4. Emasculation

By the antient law of England, castration
was made part of the punishment for rape. 2. Inst. 180 Mirror c.4. § 8.
de Homicide — Alfred virga praecitor
had
the abscription gone a little farther, it would have
had the effect which is here in view. Whether
it would have been eligible on other grounds, I
shall not here enquire. It seems at any rate more
eligible than the present punishment of death.
But this line of policy seems hardly to
rataless the limits of direct and ordinary legislation.

Casus particularis

Muto linguam. De
virginibus puerisque, sed
non virginibus puerisve
sermo est; et in alieno
sermone, quæ in virnanto
intolerabilia. igitur verciundum exemplum tubens sequor.
Goldsmith's History of animated nature:
ubi de simiæ
faciens, mens miantionen refert.
Dixi adversus potestatem peccandi quam ab
intra nomenavi, nullum dari remedium. En vero exceptionem:
circumcisio Dicitur non apud Judæos solos circumscisio
vitam fuisse in uso.
Adversus
debilitatem remedium sterilesque nuptias: &
quidni huc pertineat Juddæos gentis vista spectata
fecunditas? Vitiam magis perniciosum
quam quae
multo sunt odiosiora:
siquidem magis debilitat,
& precio homosibi semper
præsens.
Sed nec vitiam videtur nec remedium rudem
secula convirsire ævum sapere: virseniliusque faciliusque crediderim
huac impentasse hodierios attribuisse ascriptisse , quam illam antiquos invenisse.
