The method of division here specified in question may
be considered as a distinct method from that which
was in question under the former head. This will
hold equally good according upon to which principle soever
one branch is distinguished from another; whether
according to the nature of the power considered in the
abstract, or according to the nature of the power
considered with respect to the services "functions of government comes to which it is

These modes methods of division apply each of them
to one power of misrule as well as to another.
They are capable of taking place at one stage
of the climax of government as well as at another;
in either case they are capable of displaying
a degree of efficacy more or less considerable.
In the provinces of Russia before previously the late regulations
took place judicial power, all the different branches
of power, military, fiscal, judicial were judged in
the same body of man: thus far the constitution
of those subordinate governments resembled the simplest of the forms of
