§ Diverting the exercise of power by rules & formalities.
This is another head of policy which is as with regard applicable
to all subordinate offices is as applicable
to the constitution of an absolute a monarchical as of a mixt government.
If he the sovereign has an interest in keeping
himself free from the restraints of law, he has none
in communicating the like license to his servants. It will be no diminution
of his power
to establish laws
