Secret informations
enmity of the delinquent, will not choose to expose
himself to a certain inconvenience even though it be but the
inconvenience of standing
in this invidious light
for the chance of
rendering to the public at the price expense of a great
deal of trouble an uncertain benefit. By this means Nine instances
of delinquency out of ten never come to light.
But even suppose the obstacle overcome: why should
a man be unnecessarily made a sufferer perhaps
for his public spirit, at any rate for his intentions
to do service?
I mention this under the head of misrule:
because it is principally against place men
men in power that its efficacy would be most
conspicuous: since in this case to the danger of
incurrin power of the supposed delinquent adds is
forc an additional weight force in the scale of dissuading
motives. In cases of this sort without inconvenience
to the informant and yet without
injustice to the party informed against: the first offence is
passed over
the superior
having received a clue given him, detects him in
a second.
Suppose the informant in his first and anonymous
information pretends not to have seen the fact
himself but to have had it from another. what
is to be done there? At what time ought the names
& descriptions of the witnesses informant and others, to be communicated
to the defendant. These are questions which would require
specifications and distinctions too minute to be given here.
