Mischief

Compensation
is ejusdem generis, or
elsewise — lucrative
or vindictive.
We come now to [the means of combating
mischief by] compensation. Compensation is either
good bestowd in consideration on consideration of
evil suffer'd. Now the good may be of the same
nature as the evil or of a different nature: in
the first case the compensation may be said to
be ejusdem generis: in the other, diversi generis
For the mischief done by offenses against reputation,
the compensation may be ejusdem generis,
by being of the vindictive kind. So in some case may
that of offences against property, by being of the
lucrative kind: tho' this in strictness can hardly
be said to be the case except where the injury
is in strictly speaking a mere pecuniary one. in
the narrowest sense of the word pecuniary. As to
offences aga that against the person, and those
which concern a man's condition in life, for
these it is manifest enough that no other sort of compensation
can be provided than what is diversi
