Mischief

offences however whatever loss may be sustained
in point of reputation by the party injured, the
enjoyment of the offender arises not, any part of
it, from that source:

of insult.

whereas in offences of enmity,
such as defamation and vilification are frequently
are, and in corporal insults almost always, whatever
is lost by the party injured is so much gained
as it were, or at least so much enjoy'd by the offender:
in the one case the offence is to reputation
what destruction is on the other with
regard to property; in the other what theft is with
