Indirect Legislation § 10
Mischief
the instruments of good, [such of them as are at
disposable to the disposal of the legislator] are
the produce of labour, or at any rate of some
evil: (a)
NOTE
(a) In the case of vindictive compensation, the
instrument if it so it may be termed, or cause
of the good that is bestowd produced , is an evil, which
is not is of a different kind from that of labour: viz, the suffering felt which the
offender is made to undergo.
and labour is in itself an evil. If any
thing then is to be done to any advantage in
the way of supplying compensation, it must be
in short if compensation be of any kind
be a thing which ought in point of utility can in any case be renderd
a beneficial thing upon the whole ought in any case to be offended , it can
only be by the reparation given to the of
the expence: by the in choice that is made
of the fund out of which by which the expenditure
is to come. be borne.
