Indemnification
may be effected
by the public
1. for the mischief
of the offence
The I Institutions providing a public insurance
fund for losses of this nature may have two objects be of two
sorts
1. A fund for definitive indemnification indemnifying
those who are sufferers by crimes: or that re-imbursing of losses or in the case
1. Where the offender is unknown or proves insolvent,
to reimburse the loss in his stead can make amends
in his stead the loss occasioned by the offence.

2. A fund for defraying in the first instance the costs of prosecution the costs of suit: the costs
that must be incurred before it can be known
whether the person alledged to have offended has
offended in reality. This will be applicable as
well to the cases where the indemnification is
expected to come out of the pocket of the offender, as
where [it can only be obtained out of] the public
fund must be resorted to.
This might even be
extended to civil contests of a purely civil nature.
This institution it may be observed is just
