[Indirect Legislation]
Mischief
-ness of the body of the work. But before we enter upon
those details the detail, it may be of use it may be of use
to give a sort of analytical view sketch of the possible
measures which courses that can be taken for the accomplishment
of that end, whether by punishment or by
any other means.
The object proposed end or purpose or desideratum is in every case
to prevent mischief: under which head to save or what frequently comes to the same
thing, to produce positive good. In as far as they are words we will consider as well negative mischief
as positive distinct it is chiefly with the former [only] of these
ends that we are concerned at present. When the
To prevent mischief in part is the same thing with
palliating it when consider'd all together. and to cure make amends for it is the
same thing with preventing it at the long
run.
Now there
are two ways in which mischief considerd as liable to
result from any act
may be prevented
or palliated by : 1. by preventing or palliating it as consider'd
in itself: 2. by preventing the obnoxious act
from which it is expected to arise. It is commonly
because the former method course is impracticable that
the latter is pursued. This is to be understood of
total prevention: but to palliation to palliate the
mischief in some degree is not unfrequently in the
legislator's power. [Now] it is manifest enough that if
the whole mischief of any act could be prevented or made amends for , the
act itself would be a matter of indifference. If a man
