and till he has render'd the one service which
it belongs to him to render he is sure of not
receiving the service which it is requisite for
him to receive. All this is done a The money
thus obtained of him is obtained without any of
the formalities of procedure. The part which it is
requisite for the law to act in order to bring him
to its own terms is purely negative: the with-holding
from him those services without which his the
enjoyment of every thing he has property, would be insecure. Put the tax the
other way, and you will let the conveyance to him be
still valid as at first, and lay a fine on him subject him only to a
fine in case of his not paying the duty, and
you will see the difference. How are you to suspect
that he has any such conveyance made to him?
or should you suspect it how will you get evidence:
a penal prosecution must be set in foot
against him: witnesses may die or be out of the
way: attempt to examine and he will tell you,
if it be where the English law prevails, [that he
is not to be made to accuse himself:] that whatever
be his guilt you have no right to oblige him put him into a situation
to betray it: the jury may be out of humour
