WagersAnother instance in which an emolument is
liable in an indirect a way not altogether obvious
to operate as have the effect of a reward, is that of wagering. wagers.
A wager is a contract whereby one person undertakes
to pay a certain sum of money or perform
some other service in case of the happening
of an event
which is looked upon
as uncertain by one or other of the
parties as uncertain
in consideration of another
person's undertaking to pay another sum of money
or perform some other service in case of the
happening of some other event, which is also
looked upon as uncertain: as if a man were to
say to you I will lay you two pound that
Peter does not die within this twelvemonth, and
you were to say — agreed. It is evident that if
the event upon which the either service is
stipulated to be renderd be an event which it is
in the power of either the party to whom the emolument
would accrue to produce, the wager has
thereby a tendency to act in the capacity of a
reward, prompting him to endeavour at the
production of that event. It affords an impelling
motive, whatever restraining motives there may be.
