Reward
§ 3 Cases unmeet
of which should it take place, the party to
whom the emolument is destined will have been is instrumental,

offer'd, and intentional reward] it then plainly
appears that the emolument was designed to
act in the capacity of a reward: as if the
wager were, I lay you ten pound that
you do not kill Peter within this twelvemonth.
And in this case if the wager be accepted
it will appear it will appear that
the emolument not only had acted in that capacity
but had acted with effect. But it might also
be intended to act in that capacity without such
intentions being expressed: it might even act in
that capacity without being intended so to do. Indeed
it is plain that the expression or non-expression
and the absence or presence - , of such intention are
circumstances which in of themselves can not either
them make any difference with regard to
the effect of the an emolument thus provided. But
the efficacy of that emolument in the capacity
of reward will depend upon the ratio of the
impelling motive which it furnishes to the whatever restraining
motives the case may furnish.
