The statute of frauds and perjuries proceeds upon two grounds: suppositions: one is which indeed run throughout
the whole of the English common law. One is that
all the riches of Peru when sever'd from the earth once they are dug out
of the mine
that bore them are of less value than a piece
of bog of a yard square: the other is that an
estate which is to belongs to you and your representatives
for a thousand years to come is of less value to you than the same
estate would be were it to belong continue to you for whatever
there may happen to remain of the life of your
great grandfather. Accordingly a million of money
may be bequeathed by the help of one witness without writing,
or by a writing without witness: but the devise of the piece of
bog if given for life must would not be good
without writing and three witnesses into the bargain, who must
every one of them be free from all exception. This being the case It
is evident enough that whether it be expedient to exact
require the observance of these formalities in a
will or whether it be not, the good sense of this
statute stands upon an equal footing. If people
are disposed to perjury, the people whose mode who are apt
of estimating the value of property is not much to estimate money upon principles somewhat different from
these legal principles
exactly the same as that followd by these lawyers
will be as apt to have or suborn perjuries perjure themselves
for [a thousand money as for land] a thousand pounds worth
of money as for a thousand pounds worth of land.
