The want of these
will put people
upon their guard
Distinction between
wills & deeds

It may be said and naturally enough that advice instruction
without obligation will not answer the purpose [if notwithstanding
such advice the formalities recommended be not observed
]
[When every thing is fair indeed the instruction will be
observed: when fraud is practised as the observance
of the instruction will then be impracticable accordingly
it will not be observed.] When there is no fraud in the case
the pursuing of the instruction will be productive of produce nothing but
embarrassment: and, when there is fraud the instruction
will of course not be pursued. at all. The answer
is that were such advice to be given the probability
is that in general it would be taken; especially
if the its neglect of it were to be enforced by some trifling penalty:
if then upon any occasion it were found
not to be observed the non-observance would naturally
put people upon their guard: the omission want
of the formalities omitted were suspicion would arise:
and nothing less than a very strong appearance of fairness
such an one as fraud would in all p likelyhood
find it impossible to put on, would be
sufficient to support the credit of
the deed.

The degree of strictness which it will be proper
to observe in with regard to any sort of deed will depend
upon two circumstances: 1. upon the certainty
there is of the parties knowing what the formalities are
that are to be observed and what the consequences are of
not observing them: 2. upon the certainty there is of their
having it in their power to observe them.
