Wills are the instruments which are the most
exposed of any to forgery in the way of fabrication. v. supra
This might Against this species of fraud they might acquire a sure protection
were they to be required it made requisite for them
to be register'd, on pain of
nullity during the life time of the testator. An objection
against this is that by this means he
would be left thrown too much at into the powers mercy of those about
him, without the power of rewarding good
or punishing bad treatment in his last moments.
This however might be con sufficiently obviated, by
[allowing him exempting from that formality to dispose of a smaller portion without that formality] not
exceeding a tenth part, suppose, of the value of
what he leaves.
What gen instruments ought to be subjected
to registration? all instruments in which the genuineness
and publicity of which third persons may have an interest,
and of which which are of suffic the importance is sufficient to
make it worth the while. The French law on
this subject of which presently, seems to have
follow'd a very judicious proper medium.
