which consist in the sale of poisons. Of this
nature too are all those offences which on a former
occasion have been distinguished by the appellation
of offences through calamity, Ch. 16. Division. 17.
and which have been dismissed
as not coming within the design of this the present essay.
An offence of this sort stamp is created as often as any regulation
is made which comes under that division of the laws
of police which takes the prevention of calamities for its object.
The fourth are what may be termed evidentiary offences: offences which
afford a presumption whether mischievous or no
of themselves afford a presumption of the past actual
commission of others which are mischievous. Thus By an English statute
a certain sort of behaviour on the part of a woman is made punishable
as murder, under the notion of its affording a conclusive evidence of
the perpetration of infanticide.
