It may happen that there is compleat evidence
of an attempt or preparation when the consummation
of the offence remains a matter of uncertainty:
or it may happen that the fact consummation of the
offence is out of doubt, but it remains a question
by whom it was committed. In either of
these cases the inchoate offence may operate as
evidentiary of the consummated offence.
